Terms of Use – Smart Plumber

 

These Terms of Use ("Terms") govern your use of the Smart Plumber mobile application ("App") provided by Pool By Engineer Inc. ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

 

1. License We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your own professional or personal purposes, subject to these Terms and applicable laws.

 

2. AccountYou may need to create an account using an email address, password, or Sign in with Apple. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

 

3. Subscription and BillingSmart Plumber offers subscription-based access to premium features.

   3.1 Subscription• The App currently offers a monthly subscription ("Smart Plumber Monthly").

         • Payment is charged to your Apple ID account at confirmation of purchase.

   3.2 Auto-Renewal

         • Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing                    period.

         • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

   3.3 Managing Subscriptions

         • You can manage and cancel your subscription in your Apple ID account settings after purchase.

         • We do not process refunds directly. Any refund requests must be handled by Apple under their refund policies.

 

4. Professional Responsibility The App is a design and estimation tool to assist qualified professionals.

   • You remain solely responsible for verifying all dimensions, routes, clearances, pipe sizes, fittings, and compliance             with local building codes and safety standards.

   • We do not warrant that any route, calculation, or cost estimate provided by the App is free of error or suitable for a specific project.

   • You agree that you will not rely solely on the App without independent verification.

 

5. Acceptable Use You agree not to:

  • Use the App for any unlawful purpose;

  • Reverse engineer, decompile, or attempt to derive the source code of the App;

  • Circumvent or attempt to bypass subscription or access controls;

  • Use the App to develop or support a competing product.

 

6. Intellectual Property All content and software included in the App (excluding your own data) are owned by Pool By Engineer Inc. or its licensors and are protected by copyright and other intellectual property laws.

 

7. Disclaimer of Warranties The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

8. Limitation of Liability To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or related to your use of the App.

 

9. Termination We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or engage in fraudulent or abusive use of the App.

 

10. Changes to the Terms We may update these Terms from time to time. The updated Terms will be made available in the App and/or on our website, and your continued use of the App after the changes are posted constitutes your acceptance of the updated Terms.

 

11. Governing Law These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles.
